Lease, Hak Pakai, HGB, PT PMA

Hak Milik, full freehold, is reserved for Indonesian citizens. That single sentence explains nearly every complicated thing that follows.

A lease, Hak Sewa, is what most foreign buyers actually sign: commonly 25 to 30 years with an extension option. It needs no residency permit, which is exactly why it dominates the market, but it does not always create a registrable land right.

Hak Pakai, a right of use, requires a KITAS or KITAP. Where a foreigner acquires a landed house on freehold or building-right land, the title is converted to Hak Pakai. Foreign holders are limited in principle to one plot or 2,000 square metres.

HGB, the right to build, is held through a PT PMA, and that is the route for anyone who intends to rent commercially. It carries a minimum investment above IDR 10 billion per line of business per location, excluding land and buildings, of which IDR 2.5 billion is paid up at incorporation. Half the internet reports that 2.5 as the whole requirement. It is not.

There is no island-wide ban on building. There is something stricter.

You will find lists naming six regencies as closed by moratorium. We could not confirm that list in any Indonesian primary or press source, and we are not going to repeat it.

What is documented: in January 2025 Governor Wayan Koster explicitly rejected a blanket moratorium, saying strict control was needed instead of one. In September 2025, after flooding that killed 17 people, he banned conversion of productive agricultural land for commercial use across the province, with instructions issued to every regent and mayor.

The distinction matters to your budget. A moratorium is a door that reopens. A conversion ban plus active enforcement is a permanent change in what the land under an offer is worth.

A clean title on ruined ground is still a bad deal

Due diligence usually stops at the certificate. Ours does not, because the two failures that destroy value here are not registry failures. They are water and enforcement.

Groundwater has fallen by more than fifty metres in parts of Bali in under a decade, and community wells run dry or turn saline. A plot whose water supply is not secured is a plot with an expiry date, whatever the paperwork says. Meanwhile the province has banned the conversion of productive agricultural land for commercial use, and sealed projects have shown that this is enforced rather than announced.

So there are requests we decline. Green-zone land dressed up as a rezoning formality. Cliff-edge plots on the Bukit where the fill goes straight into a reef. Anything that needs a bird, a forest corridor or a neighbour's well to quietly disappear first. We would rather lose the enquiry than help produce the next sealed building site.
